Think the fog of partisan Trump investigations will lift once the President leaves office, either in 2021 or 2025? Not if Elizabeth Warren has anything to say about it. With the Iowa caucuses approaching and her campaign fortunes flagging, Senator Warren now says that as President she’d launch an open-ended criminal investigation into her predecessor and anyone who worked for him.

Ms. Warren’s latest “anti-corruption” plan says she would create “a Justice Department Task Force to investigate corruption during the Trump administration and to hold government officials accountable for illegal activity.” She would order Justice to look for violations of “federal bribery laws, insider trading laws, and other anti-corruption and public integrity laws” as well as immigration-enforcement offenses.

“This will be no ordinary transition between administrations,” the document says ominously. Team Warren won’t be satisfied with taking control of the executive branch in an election. They also want scalps of choice ex-officials. The plan links to news articles about Commerce Secretary Wilbur Ross, White House Adviser KellyanneCon way and Secretary of Housing and Urban Development Ben Carson.

If there is evidence of a crime by a former Administration official, it should be investigated through the normal channels. Ms. Warren is proposing something different: A law-enforcement task force dedicated to searching for wrongdoing only by political opponents. This would be familiar in Latin American dictatorships where the party that loses an election may be jailed as retribution.

Pundits said Mr. Trump’s 2016 campaign threat to investigate Hillary Clinton for her email mismanagement was a chilling breach of democratic norms. We opposed such an investigation but at least the alleged misconduct was limited to specific conduct by one official, whereas Ms. Warren wants investigations of all Republican officials for any political offenses.

Despite all the apocalyptic think-pieces and high-minded books, America has not become an “autocracy” three years into Donald Trump’s Presidency. The opposition party won the House in the midterms, proceeded to impeach the President, and its leading candidates are ahead in the head-to-head 2020 presidential election polls.

Yet in polarized times the temptation to criminalize political differences is stronger than ever. It will be especially strong for Democrats once they are back in control of the Justice Department. Down Senator Warren’s road lies a real threat to liberty.

Flynn Turns Tables on Prosecutors in Major Legal Blitz

Attorneys for former national security adviser Michael Flynn launched a major legal challenge in his perjury case on Aug. 30, by seeking a contempt citation against the prosecutors for hiding exculpatory evidence.

The attorneys allege Flynn was targeted for selective prosecution based on illegal surveillance and claim that the office of the special counsel extorted the guilty plea from Flynn.

Sidney Powell, Flynn’s attorney, filed the paperwork for the motions two months after taking over as the defense counsel on the case, replacing the team that Flynn fired in June. Powell, a vociferous critic of government prosecutors, confirmed to The Epoch Times that she ultimately seeks for the case to be dismissed and for Flynn to be exonerated.

The 14-page filing represents the most significant development in Flynn’s case since he pleaded guilty to lying to the FBI more than a year ago. Flynn has postponed his sentencing since the guilty plea in order to complete his cooperation with government investigators, including then-special counsel Robert Mueller.

Should the judge side with Flynn on any of the requests, the repercussions would likely expand beyond Flynn’s case, since the defense is demanding for the prosecution to hand over evidence long shielded by the government. These documents—some which have been long withheld, while others are partly redacted—would shed light on the broader special counsel investigation into Russia’s interference in the 2016 elections, as well as the FBI counterintelligence probe from which it evolved.

An interview with Trump’s top diplomat on America First and ‘the need for a reset.’

Is the Trump administration out to wreck the liberal world order? No, insisted Secretary of State Mike Pompeo in an interview at his office in Foggy Bottom last week: The administration’s aim is to align that world order with 21st-century realities.

Many of the economic and diplomatic structures Mr. Trump stands accused of undermining, Mr. Pompeo argues, were developed in the aftermath of World War II. Back then, he tells me, they “made sense for America.” But in the post-Cold War era, amid a resurgence of geopolitical competition, “I think President Trump has properly identified a need for a reset.”

Mr. Trump is suspicious of global institutions and alliances, many of which he believes are no longer paying dividends for the U.S. “When I watch President Trump give guidance to our team,” Mr. Pompeo says, “his question is always, ‘How does that structure impact America?’ ” The president isn’t interested in how a given rule “may have impacted America in the ’60s or the ’80s, or even the early 2000s,” but rather how it will enhance American power “in 2018 and beyond.”

Mr. Trump’s critics have charged that his “America First” strategy reflects a retreat from global leadership. “I see it fundamentally differently,” Mr. Pompeo says. He believes Mr. Trump “recognizes the importance of American leadership” but also of “American sovereignty.” That means Mr. Trump is “prepared to be disruptive” when the U.S. finds itself constrained by “arrangements that put America, and American workers, at a disadvantage.” Mr. Pompeo sees his task as trying to reform rules “that no longer are fair and equitable” while maintaining “the important historical relationships with Europe and the countries in Asia that are truly our partners.”

Readers may recall not long ago in this space: “What constitutes a Civil War is when certain bureaucrats within the Executive Branch of the U.S. Government, along with certain elected and appointed officials within the Legislative and the Judicial Branches of government, form a conspiracy, either formal or informal, to set aside the results of the presidential election of 2016 and to prevent the duly elected president from being able to govern effectively…”

Do not be confused about what is going on in Washington, D.C. The current tactic in the American Civil War II is to provoke President Trump into taking an action or actions that could be the basis for the charge of: Obstruction of Justice.

Note well: If and when the Democrats obtain a majority in the U.S. House of Representatives, President Trump will be impeached for something like “running with scissors when his mother told him long ago not to do that.” That, however, would not get President Trump convicted by 2/3ds of the U.S. Senate. A truly substantive charge would be required.

Recall, President Nixon was not forced out of office because some over-eager campaign underlings broke into the Watergate offices of the Democratic National Committee. The burglars were caught in the act and they were on their way to being subjected to whatever punishment the Courts and the Federal Election Commission decided to mete out. But, when President Nixon tried to cover up what happened, he obstructed justice and for that Nixon was forced to resign. Nixon’s alternative was to risk being impeached by a simple majority of the House and, possibly, convicted by 2/3ds of the U.S. Senate.

Trump is commonsensically undoing, piece by piece, the main components of Obama’s legacy.
Donald Trump continues to baffle. Never Trump Republicans still struggle to square the circle of quietly agreeing so far with most of his policies, as they loudly insist that his record is already nullified by its supposedly odious author. Or surely it soon will be discredited by the next Trumpian outrage. Or his successes belong to congressional and Cabinet members, while his failures are all his own. Rarely do they seriously reflect on what otherwise over the last year might have been the trajectory of a Clinton administration.
Contrary to popular supposition, the Left loathes Trump not just for what he has done. (It is often too consumed with fury to calibrate carefully the particulars of the Trump agenda.) Rather, it despises him mostly for what he superficially represents.
To many progressives and indeed elites of all persuasions, Trump is also the Prince of Anti-culture: mindlessly naïve American boosterism; conspicuous, 1950s-style unapologetic consumption; repetitive and limited vocabulary; fast-food culinary tastes; Queens accent; herky-jerky mannerisms; ostentatious dress; bulging appearance; poorly disguised facial expressions; embracing rather than sneering at middle-class appetites; a lack of subtlety, nuance, and ambiguity.
In short Trump’s very essence wars with everything that long ago was proven to be noble, just, and correct by Vanity Fair, NPR, The New Yorker, Google, the Upper West Side, and The Daily Show. There is not even a smidgeon of a concession that some of Trump’s policies might offer tens of thousands of forgotten inner-city youth good jobs or revitalize a dead and written-off town in the Midwest, or make the petroleum of the war-torn Persian Gulf strategically irrelevant to an oil-rich United States.

Obama and his allies had violated the norms so often for their policy goals that they couldn’t afford to be replaced by anyone but one of their own. The more Obama relied on the imperial presidency of executive orders, the less he could afford to be replaced by anyone who would undo them.  The more his staffers lied and broke the law on everything from the government shutdown to the Iran nuke sellout, the more desperately they needed to pull out all the stops to keep Trump out of office. And the more they did it, the more they couldn’t afford not to do it. Abuse of power locks you into the loop familiar to all dictators. You can’t stop riding the tiger. Once you start, you can’t afford to stop.If you want to understand why Samantha Power was unmasking names, that’s why. The hysterical obsession with destroying Trump comes from the top down. It’s not just ideology. It’s wealthy and powerful men and women who ran the country and are terrified that their crimes will be exposed.

It’s why the media increasingly sounds like the propaganda organs of a Communist country. Why there are street riots and why the internet is being censored by Google and Facebook’s “fact checking” allies. 

It’s not just ideology. It’s raw fear

 

Last week, CNN revealed (and excused) one phase of the Obama spying operation on Trump. After lying about it on MSNBC, Susan Rice admitted unmasking the identities of Trump officials to Congress.

Rice was unmasking the names of Trump officials a month before leaving office. The targets may have included her own successor, General Flynn, who was forced out of office using leaked surveillance.
