Flynn Turns Tables on Prosecutors in Major Legal Blitz

Attorneys for former national security adviser Michael Flynn launched a major legal challenge in his perjury case on Aug. 30, by seeking a contempt citation against the prosecutors for hiding exculpatory evidence.

The attorneys allege Flynn was targeted for selective prosecution based on illegal surveillance and claim that the office of the special counsel extorted the guilty plea from Flynn.

Sidney Powell, Flynn’s attorney, filed the paperwork for the motions two months after taking over as the defense counsel on the case, replacing the team that Flynn fired in June. Powell, a vociferous critic of government prosecutors, confirmed to The Epoch Times that she ultimately seeks for the case to be dismissed and for Flynn to be exonerated.

The 14-page filing represents the most significant development in Flynn’s case since he pleaded guilty to lying to the FBI more than a year ago. Flynn has postponed his sentencing since the guilty plea in order to complete his cooperation with government investigators, including then-special counsel Robert Mueller.

Should the judge side with Flynn on any of the requests, the repercussions would likely expand beyond Flynn’s case, since the defense is demanding for the prosecution to hand over evidence long shielded by the government. These documents—some which have been long withheld, while others are partly redacted—would shed light on the broader special counsel investigation into Russia’s interference in the 2016 elections, as well as the FBI counterintelligence probe from which it evolved.

You Can’t Blame Trump for Baltimore’s Failure

Ineffective and dishonest politicians have used racism as a shield from criticism for half a century.

EXCERPT FROM THIS ARTICLE:  Washington’s efforts to revive Baltimore have enriched local politicians but left the city in far worse shape than Mr. Rangel’s Harlem. The American Recovery and Reinvestment Act of 2009—the Obama stimulus—poured $1.8 billion into Baltimore with no discernible effect. The 2015 antipolice riots made matters worse.

To make sense of President Trump’s dust-up with Rep. Elijah Cummings, Speaker Nancy Pelosi and the rest of the Democratic Party, you have to go back to Baltimore in April 1968, when the city was overwhelmed by a riot in the wake of Martin Luther King Jr.’s assassination. The National Guard and city police proved unable to contain the situation. Mayor Tommy D’Alesandro III, Mrs. Pelosi’s elder brother, pleaded with President Lyndon B. Johnson to send in federal troops.

In 1968 Maryland hadn’t yet been absorbed by the wealth of Washington. It was still a semi-Southern state, lying below the Mason-Dixon Line. Republican Spiro Agnew—later Richard Nixon’s vice president—had been elected governor in 1966 over a segregationist Democratic nominee. In the black areas of West and East Baltimore, the King assassination triggered four days of rioting and looting.

The conflict was so fierce that the Baltimore police, 500 state troopers and 6,000 National Guardsmen were unable to quell it. Finally the “insurrection” was halted when Johnson deployed nearly 5,000 Army troops at Agnew’s request. By the time it was over, six people were dead. Mr. D’Alesandro, who had considered running for governor, was so humiliated by the rioting in a city where his father has been mayor before him that he decided to withdraw from elective politics.

Earlier that year, the Johnson administration reluctantly released the report of the National Advisory Commission on Civil Disorders, commonly known as the Kerner Commission. The report wasn’t to LBJ’s liking because it implied that his Great Society was an insignificant down payment on racial redress. The presidential panel—assembled to explain the 1967 race riots in Chicago, Detroit, Los Angeles and Newark, N.J.—should have been called the Lindsay Commission, after its vice chairman, New York Mayor John Lindsay. America’s racial problems, the report claimed, could be singularly attributed to white racism: “Our nation is moving toward two societies, one black, one white—separate and unequal.”

Over time, the Kerner Commission’s view of racism became gospel in the media, academia and the Democratic Party. An intellectual Iron Curtain descended to protect black politicians—including ineffective ones like Mr. Cummings and even con men like the Rev. Al Sharpton—by denouncing their critics as racist.

Transgender Illegal Aliens Get Special Treatment, Hormone Therapy Under Policy Issued by Trump’s Border Czar

Immigration centers are dangerously overcrowded yet the federal agency slammed with an onslaught of migrants provides a separate unit for transgender illegal immigrants as well as costly hormone therapy and a number of other perks. Thanks to an Obama policy continued by the Trump administration, Immigration and Customs Enforcement (ICE) gives transgender illegal aliens special treatment, including their own detention center in New Mexico that offers hair and makeup classes, a recreation area, gym, television rooms, a lab and pharmacy. There are also meeting areas for trans detainees to consult with free legal services provided by advocacy groups. American taxpayers furnish the hormone therapy, which “is not cheap,”according to an ICE director quoted in a recent news report about the New Mexico transgender facility, which opened in 2017.

The reality is that ICE has long offered transgender illegal immigrants special services under an Obama-era policy that the Trump administration can easily reverse but has chosen not to. ICE officials and frontline personnel are outraged that the Trump administration continues the policies, which some in the agency refer to as dangerous, expensive and foolish. Rank and file are at their wits end, according to ICE officials interviewed by Judicial Watch this week. “Two and a half years of the Trump administration and we still have Obama detention standards,” said Chris Crane, president of the National ICE Council, which represents 7,600 officers, agents and employees throughout the U.S. “This is not a new policy for ICE. It came out under the performance-based detention standards in 2011 and was updated in 2013 and 2016.” Crane said the National ICE Council addressed the agency’s detrimental detention issues with Trump’s first Homeland Security Secretary, John Kelly, who ordered changes that never materialized.

How many union workers does it take to screw in a light bulb?

The Green New Deal that Democrats unveiled last week has a grand ambition to eliminate fossil fuels in 10 years, retrofit every building in America, and guarantee high-paying jobs in the bargain. If you want to see how that works in the real world, consider the public housing projects near Rep. Alexandria Ocasio-Cortez’s New York office.

The New York City Housing Authority (Nycha) has a more modest goal of a 30% reduction in greenhouse-gas emissions by 2027. As part of its plan, Nycha is switching to LED lighting, which lasts longer than incandescent bulbs and consumes less energy. Sounds smart, until you see how many union workers it takes to screw in a light bulb.

One recent project focused on 23 housing developments, and changing the light bulbs and fixtures there cost $33.2 million. Supplies account for a fraction of that cost. Under Nycha’s Project Labor Agreement, electricians make $81 in base pay and $54 in fringe per hour, and overtime is usually time and a half. Add administrative and contracting expenses. All in, Nycha paid an average of $1,973 per apartment to install LEDs.

For Ms. Ocasio-Cortez, sky-high labor costs are part of the plan. Her Green New Deal resolution would create “high-quality union jobs that pay prevailing wages” and reinforce “the right of all workers to organize, unionize, and collectively bargain.” It also mandates upgrades for “all existing buildings in the United States” to “achieve maximal energy efficiency.” In this worker’s paradise, there’s a $1,973 LED in every socket.

Ms. Ocasio-Cortez’s proposal also states that a Green New Deal “must be developed through transparent and inclusive consultation, collaboration, and partnership” with both labor and low-income families. But if she visited the Nycha homes, she may find those mandates are at odds.

“I can buy LED myself,” said Barbara Jones, 69, who has lived in Cypress Hills since her 20s and is dismayed by the disrepair. Others we interviewed said they’d rather see money go first to getting rid of vermin, mold and lead paint, tidying filthy premises, or improving safety.

Nycha also updated the heat and hot water systems in addition to upgrading the lights at these 23 developments, and the total cost for the energy-efficiency overhaul was $68.7 million. A Consolidated Edison grant covered $8.25 million, but Nycha took out a loan to cover the rest. The housing authority has three similar projects in construction at other developments, and the total cost for all four is $271.8 million.

LED lights and other energy-efficiency upgrades may drive Nycha’s utility bills down, but those savings aren’t directly passed on to taxpayers for as long as 20 years. Under the federal Energy Performance Contracting Program, the federal Department of Housing and Urban Development continues to reimburse Nycha for utilities at pre-LED levels. Public housing authorities must spend a minimum of 75% of their savings on servicing the loan and other project costs, but they have more discretion over the rest.

In the private economy, $1,973 could go a long way toward improving a dilapidated apartment. Only in the world of green government spending is replacing light bulbs for two grand a unit a cost-saving measure.

There’s a reason why you haven’t heard much from Lt. Gen. Michael Flynn lately. The man who served his country honorably for 33 years has been effectively silenced by special counsel Robert Mueller as he awaits sentencing.

Given the circumstances of his plea deal, Flynn cannot speak publicly about anything related to the charges against him. Doing so could void his plea agreement with Mueller’s team and open him up to further legal proceedings that he is financially unable to defend himself against.

Flynn, who has worked his entire career on a government salary, has spent over one million dollars on his legal defense. The financial burden has forced him to sell his home in Alexandria, Virginia, and move into a family home in Rhode Island.

He has been effectively bankrupted and has had his reputation torn to shreds, all for the supposed crime of misleading the FBI about a perfectly legal conversation he had, as incoming national security adviser, with the former Russian ambassador to the U.S.

It’s 105 degrees as I stand with Rep. Devin Nunes on his family’s dairy farm. Mr. Nunes has been feeling even more heat in Washington, where as chairman of the House Select Committee on Intelligence he has labored to unearth the truth about the Federal Bureau of Investigation’s activities during and after the 2016 presidential campaign. Thanks in large part to his work, we now know that the FBI used informants against Donald Trump’s campaign, that it obtained surveillance warrants based on opposition research conducted for Hillary Clinton’s campaign, and that after the election Obama administration officials “unmasked” and monitored the incoming team.

Mr. Nunes’s efforts have provoked extraordinary partisan and institutional fury in Washington—across the aisle, in the FBI and other law-enforcement and intelligence agencies, in the media. “On any given day there are dozens of attacks, each one wilder in its claims,” he says. Why does he keep at it? “First of all, because it’s my job. This is a basic congressional investigation, and we follow the facts,” he says. The “bigger picture,” he adds, is that in “a lot of the bad and problematic countries” that Intelligence Committee members investigate, “this is what they do there. There is a political party that controls the intelligence agencies, controls the media, all to ensure that party stays in power. If we get to that here, we no longer have a functioning republic. We can’t let that happen.”

Mr. Nunes, 44, was elected to Congress in 2002 from Central California. He joined the Intelligence Committee in 2011 and delved into the statutes, standards and norms that underpin U.S. spying. That taught him to look for “red flags,” information or events that don’t feel right and indicate a deeper problem. He noticed some soon after the 2016 election.

Just How Far Will the Left Go?

There was no honeymoon for the unlikely winner of the 2016 election. Progressives have in succession tried to sue to overturn Trump’s victory using several different approaches. First on the bogus claim of fraudulent voting machines. Then they sought to subvert the Electoral College by bullying electors into renouncing their respective states’ votes.

Massive protests and boycotts marked the inauguration. Then there were articles of impeachment introduced in the House. Some sued to remove Trump on a warped interpretation of the Emoluments Clause of the Constitution. Others brought in psychiatrists to testify that Trump was ill, disabled, or insane and should be removed in accordance with the 25th Amendment. The former FBI director, CIA director, and director of the Office of National Intelligence have variously smeared the president as a coward, a traitor, and a Russian mole.

The Mueller Investigation
We are about 430 days into Robert Mueller’s investigation; the special prosecutor whose team of lawyers and investigators has in a large part been made up either of Clinton donors, clear Clinton partisans, lawyers who have in the past represented Clinton interests or employees, or partisans already removed for expressing clear Trump hatred. The media grew ecstatic over its creation, dubbing it an “all-star” or “dream” team, as leaks assured the public that next week, next month, or “soon” there would be a sensational indictment proving that Trump colluded with the Russians to win the presidency.

We have gone through the psychodramas surrounding Michael Cohen, Stormy Daniels, Michael Flynn, Jared Kushner, Paul Manafort, Carter Page and a host of others. Any second, any minute they would be indicted for collusion in throwing an election, or they would soon flip and end the Trump presidency.

 

When we learned that Robert Mueller initially did not disclose to the media why he had fired Peter Strzok and Lisa Page, and why he had spaced out their firings to prevent the impression that they were connected, we were only reassured of the professionalism of the Mueller investigation.
